- The term of tenancy shall remain effective for the period unless terminated earlier per the terms of this Agreement.
- The annual rental sum (Rent) for the property is payable on or before the expiration of the tenancy.
- That a security deposit, separate from the Rent, is due upon the execution of the Agreement.
- The security deposit shall be held for the duration of the tenancy and returned within 30 days after the termination of the lease, less any deductions for damages or unpaid Rent.
- That all the aforementioned sum covers only the cost of rental of the specific property. As such does not include any additional charges, costs, maintenance fees, etc.
Further to all the above:
THE TENANT COVENANTS AS FOLLOWS:
- Shall pay the Rent always in advance before the termination of the current term.
- Shall keep the said property, flat, its rooms, and premises (including the windows, shutters, doors, locks, fastenings, fixtures, fittings and other conveniences constituting the premises) in good and Tenant-like repair and condition (fair wear and tear exempted) throughout the term hereby granted.
- Shall replace any damaged or missing fitting or fixture at the expiration of the term or to pay the Landlord a sum of money representing the assessed or estimated cost of the said damage or loss.
- Shall pay and discharge all rates, levies and taxes, including water, tenement, sanitation, security, and improvement rates, which within the currency of the Tenancy as may be charged upon the premises or chargeable on the owner or occupier thereof.
- Shall not bypass electricity metres. Bypassing prepaid metres shall attract a penalty as legally specified law by AEDC. The Tenant agrees to pay all sums in the event of such penalty.
- Shall keep all electronic devices, fittings, inverters, power and solar systems in functional conditions whilst ensuring their maintenance throughout the term hereby granted.
- Shall not access the property at odd hours particularly late at night from hours of 10 PM till 6 AM. For extenuating circumstances, the Tenant covenants to make necessary arrangements with on-premise security and keep them continually informed of their circumstance as far in advance as possible.
- Ensure that vehicles are parked only in designated parking areas.
- Ensure that designated wheeled bins are used strictly for waste collection. In addition, the Tenant agrees to dispose of their waste in their own designated bins only.
- Shall cooperate with security personnel and adhere to established security protocols and residential policy guidelines as stipulated. A full copy of all policies is available here (https://support.urabaker.com/knowledge-base).
- Shall acquire adequate security and fire-fighting equipment and accessories, including but not limited to fire extinguishers, CCTV, smoke detectors, etc.
- Shall cooperate with other occupants in the premises to ensure general cleanliness and sanitation in the premises.
- Shall permit the Landlord or her agent, with or without workmen or others, at all reasonable times to enter and examine the condition of the demised premises and, upon notice being given by the Landlord, to execute repairs on any part of the demised premises.
- Shall not make or permit to be made any structural alteration in addition to the demised premises without first presenting to the Landlord in writing the detailed renovation proposed and obtaining her written approval to such proposal.
- The tenancy is personal to the Tenant; the Tenant shall not assign, sublet or part with possession of the demised premises or any part thereof.
- Shall not permit to be done upon the demised premises anything which may be or become a nuisance or annoyance or in any way interfere with the quiet enjoyment or comfort of any other person in the compound or neighbourhood.
- Shall not use or suffer the demised premises to be used for illegal or immoral purposes.
- Shall not keep or allow to be kept a pet or for any other purposes any animal of a ferocious nature.
- Shall the Tenant desire a renewal of this tenancy, the Tenant shall within three (3) months before the expiration of the tenancy give notice in writing to the Landlord or representatives of their intention to renew the tenancy and the Landlord may at their pleasure, at the expense of the Tenant renew the tenancy for a further term as they may decide at a reviewed Rent, terms and conditions. Failure to formally apply for a renewal as prescribed here will automatically bring this tenancy to an end at the end of the term hereby granted.
- Failure of the Tenant to renew the tenancy 2(two) months after the expiration of the tenancy shall amount to vacation of the said property and as such be liable to pay the arrears of the months stayed before vacating the said property.
- Shall indemnify the Landlord against all damages or injury to the property or to third parties caused by the act or default of the Tenant.
- At the termination of the tenancy, the tenant shall peaceably yield to the Landlord possession of the property.
Further to all the above:
THE LANDLORD CONVENTS AS FOLLOWS:
- That the Tenant paying the Rent here reserved, observing and performing the Covenants and stipulations on their part thereto shall peaceably hold and enjoy the demised premises throughout the term hereby granted without any interruption by the Landlord or any person rightfully claiming through her.
- To keep the demised premises structurally sound, wind and water-tight and all drains and boundary walls in good and Tenantable repair and condition and the exterior thereof in a reasonable state of decorative repair.
- That if the Tenant is desirous of continuing the tenancy hereby created, the Landlord shall on the written request from the Tenant made within three (3) calendar months before the expiration of the term and if there shall at the time to be an existing breach of covenant on the part of the Tenant and at the expense of the Tenant grant to the Tenant a further term of one (1) year subject to the same covenants and provisions as are herein contained, except the covenant as to the amount of Rent which shall be the open market rental value on similar premises, for the time being.
- That this agreement shall be determined by either party hereto giving the other 3 (three) months' notice in writing before the expiration of the tenancy.
- All notices or communications which may be required to be given under this agreement shall be deemed sufficiently served if it is delivered by hand or after such a notice is posted on a conspicuous part of the demised premises.
